AIBE Eligibility: Who Can Appear

The eligibility rules for the All India Bar Examination are straightforward, but one step trips people up. Here is exactly who can appear — then start practising free with source-anchored mock tests.

The core eligibility criteria

To be eligible for the AIBE, you need all of the following:

Law degreeA 3-year or 5-year LLB from a university/institution recognised by the Bar Council of India.
Bar Council enrolmentEnrolment as an advocate with a State Bar Council under Section 24 of the Advocates Act, 1961.
AgeNo limit — neither a lower nor an upper age bar.
AttemptsNo cap — you may appear until you pass (see the note below on the two-year expectation).

The step people miss: enrol first, then sit the exam

This is the part that confuses many candidates. The AIBE is not something you take straight after your LLB result. The order is:

  1. Complete your LLB from a BCI-recognised university.
  2. Enrol as an advocate with a State Bar Council under §24 of the Advocates Act, 1961 (this is a provisional enrolment).
  3. Appear for and pass the AIBE.
  4. Receive the Certificate of Practice (CoP) from the Bar Council of India, which lets you practise and appear in courts across India.

In other words, enrolment comes first and the exam second — you must already be enrolled with a State Bar Council to be eligible to sit the AIBE.

Degree recognition — what counts

  • Your LLB must be from an institution recognised by the Bar Council of India — a degree from a non-recognised institution does not qualify for enrolment.
  • Distance or correspondence LLB: the BCI generally does not recognise law degrees earned through distance/correspondence mode for enrolment. Regular-mode study is expected.
  • Foreign law degrees need to be recognised by the BCI (and may require a qualifying process) before you can enrol.

Recognition questions are decided by the State Bar Council at enrolment — if your case is unusual, confirm with them before applying.

Age & number of attempts

There is no age limit to appear for the AIBE — law is a career people enter at many stages of life, and the exam reflects that. There is also no cap on attempts: you can appear as many times as you need until you clear it.

One caveat: candidates are generally expected to qualify within about two years of their provisional enrolment. The Bar Council’s position on this has varied over time, so always read the eligibility clause in the official notification for the edition you are applying to.

Documents you will typically need

  • Your State Bar Council enrolment certificate (or enrolment number).
  • Your LLB degree and mark sheets.
  • A government photo ID and recent passport-size photographs.
  • A category certificate (SC/ST/OBC/PwD), if you are claiming a concession.

The exact document list and fees are set in each edition’s official notification — treat the above as a general guide.

Frequently asked questions

Who is eligible to appear for the AIBE?

Law graduates with a 3-year or 5-year LLB from a university recognised by the Bar Council of India, who have enrolled as an advocate with a State Bar Council under Section 24 of the Advocates Act, 1961. There is no age limit and no cap on the number of attempts.

Is there an age limit for the AIBE?

No. There is neither a lower nor an upper age limit to appear for the All India Bar Examination.

How many times can I attempt the AIBE?

There is no cap on the number of attempts — you may appear until you pass. Candidates are generally expected to qualify within about two years of their provisional enrolment, but always confirm the current position from the official notification for your edition.

Do I need to enrol with a Bar Council before the AIBE?

Yes. You must first enrol as an advocate with a State Bar Council under Section 24 of the Advocates Act, 1961. Passing the AIBE then earns you the Certificate of Practice — so enrolment comes first, the exam second.

Is a distance-mode or correspondence LLB eligible for the AIBE?

Generally no. The Bar Council of India does not recognise LLB degrees obtained through distance or correspondence mode for enrolment as an advocate. Your degree must be from a BCI-recognised institution in the regular mode. Confirm your specific case with the State Bar Council.

Can final-year law students appear for the AIBE?

In general you must have completed your LLB and enrolled with a State Bar Council to appear. Some editions have allowed candidates awaiting final results to apply provisionally — so check the eligibility clause in the official notification for the edition you are applying to.
